Depending on the case, yes. This is one of those cases where even the most partisan members of the Court are going to have to stop and think about what happens when the other party is in control of the executive branch. Beyond that, these types of cases about this type of executive power don’t get a lot of attention even within Federalist Society circles (I know, I’ve been in those circles). It’s not sexy.

Out of curiosity, is there more to the Federalist society than a desire to let anti-choice nut jobs eliminate the idea of unenumerated rights, combined with striking down all regulations on big business as somehow infringing on (unenumerated) ‘rights’ of corporations.
