I don’t have a horse in this race, and because so I haven’t been following it all that closely
BUT,,, if that is what “state election law” states, then Miller has a case!

It’s what his lawyers believe state election law states, which is the opposite of the guidelines laid out by the elections board - it’s still just a desperate ploy.
