There’s no reason to require the majority of the chamber to be party to the emoluments suit. This is an excuse to try and kill the suit before the election or otherwise delay action until well after.

The rationale that individual members can’t sue on the emoluments grounds is shaky at best since the constitution doesn’t indicate any minimum number or even that a majority of a chamber move to respond. What the court is essentially saying is that we can have the tyranny of the majority - if Democrats were in minority in both house and senate, they’d lack standing to sue on emoluments grounds. That’s asinine.

This is an extremely poorly decided ruling.
