That is a minor squabble and not really relevant to the crisis at hand. It is the people who gave the orders who must be put behind bars first.

And even without the tear gas, firing across the border is an unprovoked attack on a sovereign nation.

At the point the gas was fired over the border, none of those people had broken any US laws. None.
