The element of “intent” must be included to constitute the crime, along with one of the other elements. Destruction of an entire group because of political difference is not considered genocide. Systematic destruction of cultural artefacts nor the intent to disperse a group also do not count as genocide. Genocide can also occur when a nation is not at war.

Intent is very difficult to prove, which is why many slaughters which to the person on the street seem like genocide under international law can’t be proved.
