How is that case relevant given that Cruz was not born on the US soil?
The child of an American citizen mother and non-citizen father is born a citizen, regardless of where born, if she goes to the embassy to fill out a form and the child spends 5 of its first 14 years in America.
The child of an American citizen father and non-citizen mother, born outside the country, requires a lot of hoops to be jumped through before that child is a citizen. Especially if the father is military serving abroad — they’d need DNA tests and a marriage certificate and the father’s sworn declaration that he wants the child, plus his CO’s permission, and the embassy and/or military might still decide to be dicks about it if they feel like.
