The mind boggles. Like, I get the town’s reasoning, flimsy though it is. They’re right; the racist dipshits running the church would have sued them citing the First Amendment. I don’t know if they would win that fight, especially given the new Supreme Court’s direction on saying that nothing, absolutely nothing, can interfere with the almighty liberty of the Church.
I’m a municipal planner and RLUIPA makes denying a church a very dicey affair. If you’d allow a theater or fraternal hall of the same capacity, you have to allow the church. I get where the council is coming from. Even if I don’t like the outcome, from a professional standpoint, they made the only legal call.
