No, if a crime was committed, it was not prosecuted. I have heard prosecutors explain that they are dropping a case becasue the accuded was not guilty. It is an expression that doesn’t HAVE to ONLY come from a judge or jury.

Look up the difference between civil and criminal law skinjob. Cain was never accused of any crime, therefore the term “guilt” doesn’t apply and there is no “prosecutor” but instead a “plaintiff’s attorney.” Rulings in civil court do not reference guilt at all, they are either for one side or the other.
