That’s the ‘last resort’ in terms of courts, though, not in terms of the way that the court interacts with the other branches. It’s not the last resort compared to congress, it’s the last resort because there’s no court higher than it.
In other words, if the Supreme Court rules against you, you don’t have any other resort of appeal. It doesn’t mean that you can’t, say, pass another law with substantially the same effect but modified to fit constitutionality.
