Unfortunately, thanks to our fatally flawed Constitution with its EC, its Senate that provides equal representation to Wyoming and California, and voting suppression in purplish states run by the GOP, a party does not need a majority to have absolute control of the nation and dictate rules to everyone. Even without voting suppression, a candidate could lose the presidency while winning 70% of the vote (not likely to happen but technically possible). Rule of law means nothing with a Calvinball SCOTUS that can eviscerate any legislation that helps the majority.

Indeed. Over the last 30 the years the GOP have won the popular vote once in a presidential election and yet the scotus is completely filled with radical RW extremists for a generation now.
