No, but there are others smarter than I who suggest it would be difficult to prove that he is not.

If he is going to be sent to jail then the US Govt needs to make the case stick.
The fact that they have had six months to build a case yet no charges are pending indicates to me the difficulty they are having.

I wish it was as clear cut as others here.

Most of us are not the government.
We are allowed, legally, to look at information and draw conclusions, regardless of whether charges or brought or not.
