Drunk driving laws arrest people based on a verifiable facts, like how they were driving wildly and then their BAC.

What verifiable events do we have for telling if someone is an illegal immigrant on sight? Or do you believe that they dress differently right down to their shoes than normal Americans?

Ask for their ID, they say, “sorry, I don’t have it”. That would be suspicious.
