If pres does it it is not illegal? So Biden or someone he chooses can go into the Supreme Court chambers, shoot dead all the rightwing justices. It would not be illegal for him or he could pardon the person he sent to do it. Then he can announce the justices he wants to replace them with. Then make it clear he will kill anyone who votes against his picks. Is that the kind of America they want?
