Ah, this helps things make sense:
So the “resentencing” business is the 9th Court overturning a District Court judge’s ruling that was based upon personal opinion rather than the letter of the law.
Ignoring mandatory minimums because “they’re good people” does tend to get the sentence appealed by the government, yes.
Also the part where this has been a repeated issue with the family (i.e., the first time they did it they were let off with a warning, and the second time they did it with complete disregard for the firefighting crews in the area).
