He’s going for the “I’m a foreign soldier” defense - meaning he can only be held until such time that aggressions with the US are at an end…and as there’s no war declared, they are, and he should be sent back to his home country.

Personally, I don’t think this strategy will work for him as well as he hopes.

Hmm, doesn’t “foreign soldier” operating in a US Army uniform make him a spy/saboteur? I think that would hurt his chances.
