Alito and Thomas dissent, saying only that they believe that the motion should have been granted and the case heard. They chickened out of making any judgment on the case itself - but, to be fair, that is expected. They shouldn’t make comments on the merits of the case if the case hasn’t actually been brought to the consideration of the Court.

It is appalling that Thomas and Alito thought the case deserved a hearing but it is delightful that Trump’s 3 appointees did not share that view. I’ve always detested Alito; IMHO he’s worse than Clarence Thomas.
