I think most people didn’t even realize that the police can get a warrant to search your phone records pretty easily. You just have to be connected to an investigation. If you have a friend who deals pot who calls you a lot, they can pretty easily get a warrant for your phone records.

Not to mention the daily and pervasive indignities of real, physical searches that cause damage and chaos.

The FBI actively sends people to infiltrate groups, including groups that are pretty non-violent. They’ve been doing this forever. The NYPD spied on Muslims and the only reason they got in any legal trouble was because they followed it up outside of the city sometimes.

There is still not a judicial decision that mandates DNA evidence being entered if available. Prosecutors still fight against inclusion of exculpatory DNA evidence.

All these things are a lot more concern to me than metadata analysis.
