re: #262 Killgore Trout

I took a quick look at the Federal Sentencing Guidelines (federal judges don’t have a lot of wiggle room when it comes to sentencing).

ussc.gov

Trespassing starts at level 4. At a secure government facility brings the level to 6.
If that were all there was, the perps are looking at 0-6 months.

The kicker is “for the purpose of committing a felony”. I’m no lawyer, but it seems likely from the language in the guidelines that the sentencing would be based on the felony they were attempting unless they backed out of it on there own. (getting stopped by the authorities before you actually commit the felony doesn’t help).

Unless the charges specifically spell out the felony, I think its safe to say that someone throwing out a 10-year sentence possibility is just blowing smoke.
