I stopped putting that question to DP supporters after awhile, because they avoid answering it. Or rather, like with torture, they adopt the argument that the ends justify the means. They’ve turned Blackstone’s formulation on its head, arguing that if 1 innocent is executed so that 10 Ted Bundys are likewise executed, then the DP is justified. After all, they argue, he went to trial and was found guilty, so the system worked.
