I’m not a lawyer, but that sounds like it is both ex post facto (in that it essentially levies a fine for the crime of being successful, after you have succeeded) and that it is a Bill of Attaindir (in that it legislates a fine without any need for trial and conviction). But, hey, they’re Democrats, so they can do whatever they want to. After all, they won.

(Anyone but me regret the unprecedented level of “bi-partisanship” during the Bush years? Even during the Clinton years. Yeah, there was the impeachment, but there was also the way the Republicans rolled over on their backs and pissed on their bellies over Ruth Bader Ginsburg. I figure they kind of cancel each other out)
