Yep, but it’s less than 60 days before the election. I forget the date in December when the new congress resets, but even that’s sometime mid-December.

If Kavanaugh fails and the Democrats win control of the Senate in the mid-terms, McConnell will get it rammed through in the lame duck session. If he doesn’t, then that seat will remain vacant unless Trump nominates a centrist.
