Assuming he survives his wounds (not a trivial concern given his age), the chance of him getting the death penalty here is nil.

First of all, Washington DC doesn’t have the death penalty.

Even if it did, by the time this guy were convicted and all his appeals exhausted, he’d likely be dead of natural causes.
