Indiana Attorney General Greg Zoeller is pushing the state Supreme Court to reconsider a decision that would take away Hoosiers’ rights to resist police officers who enter their homes illegally.

The case that was the basis for the high court’s May ruling originated in Vanderburgh County, where Richard Barnes pushed back when a police officer attempted to enter his home after a domestic dispute.

The court ruled that in Indiana, citizens have no right to resist police officers. But Zoeller and others said the ruling was too broad. That’s the case Zoeller’s office pressed in its briefing, filed after hours Monday.

Zoeller’s office is not saying Barnes’ conviction should be overturned, although his attorneys have also asked for a rehearing and they do want the decision reversed and his conviction vacated.

“The court should simply hold that reasonable resistance does not include battery or other violent acts against law enforcement,” the attorney general’s office argued.

“Prohibiting nonviolent resistance to illegal police conduct is unnecessary to protect the public or law enforcement.”
