One weird/oxymoronic thing about legal filings is that it’s perfectly normal to claim contradictory things as part of different defenses to arguments. The idea is that if one defense fails, you’ve stated your case for a different defense as, “Even if X isn’t true, here’s another defense (that assumes X isn’t true) with this evidence.”
