The S.Ct. ruled that the failure to have health insurance is a tax, not a penalty/fine. That’s even though it operates as a penalty.
States have increasingly been willing to give opt-outs for any number of reasons for vaccinations, and until some major deadly outbreak occurs, this will continue. And I’m talking of something along the lines of a polio outbreak, rather than measles or mumps or chicken pox - all of which are preventable.
Or some highly placed person loses a baby or close relative to a preventable illness. That might get someone’s attention. (Measles, mumps and chicken pox are at least — mostly — survived by the victims. I’m more worried about diphtheria, which might not be recognized before it’s too late. Or whooping cough in a young child.)
