Except… and this is a big except… the way that Obamacare was written there was no severability clause included. That was a technical oversight, but one that would give Kavanaugh the wiggle room to argue that on the plain language, Congress intended for all of Obamacare to fail if part failed. Just watch the gymnastics around this.
