it seems (reasonably) clear to me that many of the ‘behavioral’ laws were not written thinking anyone would abuse them to often, easily and without any pushback/oversight by the future congress

What’s even stranger is that the vacancy law was passed in 1998. It’s not like it’s a hold over from a pre-professional Congress that might only be in DC for 4 or 5 months during the year. How it isn’t capped at 90-120 days (that should be enough time to nominate and confirm a replacement), is just strange to me.
