..and I’m still undecided over how I feel about the whole issue. I think the feds can make a case for why it’s necessary but I’m having a tough time getting past letting a president make the determination by themselves. IIRC, the argument regarding the killing of Anwar al-Awlaki went along the lines of “the president didn’t authorize it on his own, it was a joint decision with a board whose appointees were put there by the president” is a distinction without much of a difference.
