Congress looks like they’re going to be repealing those provisions because it would have resulted in a significant regulatory burden on small businesses. It was a flawed provision - but one that would have generated significant revenue to balance the health care bill’s CBO score.

The problem is that eliminating the regulatory burden here means that revenue will have to be generated elsewhere.
