There’s a parallel here to the whole gay marriage thing. Marriage is held, by the government, to be a fundamental right. Barring access to that right requires that the government can show some demonstrable reason why it is in the public’s interest that it needs to be restricted. Icky feelings and a desire to punish don’t necessarily qualify.
