She should have expressed regret over making such a statement because sitting members of an ostensibly neutral judiciary shouldn’t be trying to sway an election. When they’re on the bench, they’re excluding themselves from that part of public life.

This is an optics argument. I get it, but Thomas straight up took bribes from Tea Party groups through is wife, while ruling on Tea Party involved cases before the court. Alito essentially called the President a liar by mouthing “not true” during a State of the Union speech, when Obama correctly pointed out that the Court had reversed a hundred years of precedent in Citizen’s United.

The question is where’s the limit? If Trump’s white nationalist based campaign, promises of ethnic cleansing, religious persecution, torture, first amendment abridging libel law changes and war crimes don’t meet the test by which a Supreme Court Justice can speak up then nothing does.
