Nebraska also allows for religious discrimination in adoption. Our laws protect against discrimination against sex, but not gender or orientation.

Democratic state senator Adam Morfeld tried to open an investigation against three faith-based adoption agencies here discriminating against LGBT and atheists, but the GOP legislators shut it down.

As far as I understand, they can discriminate all they want as long as they do not take any federal funding…that is the crux of the issue here, not Religious Freedom but violation of the terms and condition under which they accept financial assistance.
