But I don’t think so.

Any sane judge would throw this out immediately, but there seems to be a shortage of sane judges. For starters, they were trespassing. Second, they have no proof that the property owner was menacing them or pointing the gun (which I am quite sure he owned legally). Third, the Border Patrol has known for 10 years that the property has become the illegal alien superhighway, so the owner clearly knew what was going on and was not overreacting.

I would expect, in the unlikely event this goes to trial, the plaintiffs’ attorney would try to get a jury heavy with Hispanics, expecting sympathy. I also think he’d be pretty surprised by how Hispanic American citizens feel about illegals.
