You miss the point. The whole idea of letting states have a share of the power is letting states have a share of the power.

Questions such as who gets visitation rights are like questions of what the rules on marriage are. Different states have different laws.

Does anyone here know what Texas law is right now? Do married couples from other states have hospital visitation rights, currently, if they’re same sex? I don’t know. At a guess, the answer would be yes.

Only because of Obama:

President Obama mandated Thursday that nearly all hospitals extend visitation rights to the partners of gay men and lesbians and respect patients’ choices about who may make critical health-care decisions for them, perhaps the most significant step so far in his efforts to expand the rights of gay Americans.

If Texas state government had its way gays would have few to no rights whatsoever. Same sex civil unions are banned and out of state gay marriages aren’t recognized at all. Sexual orientation isn’t covered Texas hate crimes legislation and the Texas Republican Party want’s to reinstate anti-sodomy legislation.
