Except Franken was a professional comedian doing a schtick. Poor judgement but still done as comedy.

If you think that’s a meaningful difference then you also have to deal with the fact that Franken’s situation is worse in the sense that Tweeden ostensibly trusted him enough to fall asleep in his presence, and he violated that trust.
