I believe that Scalia and Thomas would abide by the Thurgood Marshall rule… (paraphrasing) “If I die, prop me up in my chair until a favorable president comes along.”

That’s the rule that Ginsberg and Stevens are following as well - I seem to recall both making statements in that regard based on their dislike of President Bush.
