CNN reports that the filing claims the District of Columbia and Maryland state attorneys general don’t have the right to sue Trump as an individual and even if they could, “the President still is absolutely immune.”
Sovereign immunity has, thankfully, been routinely eroded over the past few decades. Try to apply a dying doctrine to a case based on an express provision of the constitution, seems… foolish.
I’d have gone with either challenging plaintiffs’ standing, or with the political thicket argument, but, you know, to each his own.
