It is, and it isn’t. MSNBC is cable, thus not regulated by the FCC.

Should the FCC regulate out Pat Buchanan because he appeared on Political Cesspool? Probably. But then, this is exactly how Pat Buchanan and Fox get away with it. They’re not broadcast, they’re cable.
