That law would contravene Roe V. Wade either way. Procedural question…could congress/the President actually pass a law that runs directly counter to established Supreme Court rulings? Obviously the SC strikes down lots of laws, but I’ve not heard of cases where a federal bill simply ignored a previous ruling.
The SC ruled on Roe v Wade as a privacy issue. If congress passes a person-hood type bill, that would be another case entirely. It would require the SC to rule on when life begins.
