It likely never was enforceable anyway. Seems obvious from a constitutional separation of powers perspective.

Really, that’s what’s ticked me off about Obama’s handling of the situation since the GOP started piping up at the WPA. He could have argued that it was unconstitutional and dared them to prove otherwise, but instead he’s trying to create a loophole that says “So long as there’s no boots on the ground, WPA doesn’t apply.” Because I just know that’s a loophole that’s going to be further exploited by future presidents.
