Nation-States cannot, by definition, commit piracy. They can unlawfully seize a ship, but they cannot be considered pirates. The difference matters a great deal:
A Marine captured attempting to seize a ship is a Lawful Combatant, and is entitled to Prisoner Of War status. A someone doing the same thing while not in the service of a state is a Pirate. Pirates are not only Unlawful Combatants, but are also considered Enemies of the Human Race, a term that dates back to Roman times. [tips hat to Cato]
