Definitions other than a strict legal one based on specific, formal charges are equally valid in this context. They had aided and abetted Al Qaeda by their own admission and they have been freed through the efforts of a designated terrorist organization, the Haqqani network.

For contrast and perspective, Bush and Cheney have not been charged with war crimes, let alone convicted, but I would not claim that this absence of formal charges, by itself, refutes those who assert their guilt.
