Effectively that’s what his lawyer’s trying to argue. He’s trying an end-run around CA rape laws by arguing that his client did not physically penetrate her, so it can’t be ruled as such and the jury “filled in the blanks” for the prosecution’s case.
That there’s physical evidence that his client instead raped her using physical debris at the crime scene, as well as his own admission of intent to rape her, is supposed to be ignored because “his pants were on and his zipper up.”
