So I’m seeing a bunch of hoo-hah with people mentioning the Logan Act with respect to the GOP Senators and their damn near treasonous letter to Iran.

Could one of the legal folks explain it? I’m wondering if it could be applied to what they did today. I’d love to see 47 Senators get a friendly visit from US Marshals, but I know it’s not realistic.

It’s not going to happen. Technically what they did was kind of violation, sorta, maybe, however the Logan Act is Constitutionally iffy at best. Also, even if the Justice Department was of a mind to charge them the Speech and Debate Clause would be invoked, since I’m fairly certain that they had the letter read into the official record of the current session. Logan is the kind of thing you can threaten an idiotic private citizen with to try and dissuade them from a course of action, but no Administration is ever going to try and apply it to 47 sitting Senators.
