In this case, he is, but I do think most of the time politicians actually legitimately license songs to play from the copyright holders. That’s been the case in some of these— the power the artist has it to make a stink about it, not actual legal power to stop them from duly licensing it.
I’m not an expert, but I seem to recall it shaking out that way on some other uses.
