They might be able to tweak this enough to make is pass court muster. Keep in mind the GOP has no intention of actually blocking the debt limit increase. They just want a symbolic vote and would probably accept some sort of non binding resolution.

No, I don’t think so. That was a pretty solid decision (7-2).

Worse, the plan as proposed runs into some other constitutional issues. It gives the president the Power of the Purse.

I really don’t see this passing the Senate, however. At the same time, every time it gets explained it’ll make the republicans look even more, well, childish.

Look at the plan.
President can say “I want the money.”
Then either house gets to pass a bill refusing the money. But it’s not really a bill since if either house refuses, president has to veto the refusal.
If vetoed, then both houses have to try to override the veto in the normal fashion.
