Like I pointed out upthread, the President is well within his rights to direct enforcement of laws on the books. It’s the last-ditch option for the executive when he/she doesn’t like what the legislature has passed and they’ve overridden his veto - or in this case, stalled indefinitely without passing the bill containing the desired non-enforcement.
