Ummm….I don’t think so. You don’t have the right to call out fire! in a crowded theatre if there’s no fire. The flag upside down is a sign of distress. A sign, not the same as a shout in a theatre, IMO.

And a creative solution to the issue would be for the police to protect and serve,by responding to that distress signal.Even if the building were empty, repeated calls to the owner,in response to the signal,would have gone a long way in solving the issue,and likely cheaper than the lawsuits.
