He used the words in such a way as no one listening to the speech for the first time (well me, at least) would say he called Bengazi a terrorist attack.

If he were in shit for calling it an act of terrorism in that speech instead of the reverse. His supporters could argue successfully that he did not call it a terrorist attack and would likely convince an impartial jury of that.
