the irony here is that obama was advocating an essentially conservative position with respect to the civil rights movement— he was advocating bottom-up change rather than change being legislated by the courts.

No he wasn’t. He was speaking of the Constitution as flawed, a contract of negative rights for government. Restraining what government can do. He would like a Constitution of positive rights for government, what government is required to do for you.

The Conservative position is a that the Constitution is a contract of negative rights for government.

He was bemoaning that fact that the Warren court did not get in government exercising positive rights and ensuring economic justice.
